Foreclosure Sales: Buyer's REALTOR Beware

REALTORS® representing buyers in foreclosure purchases are responsible for advising their clients about Buyers' potential liability to the IRS for failure to comply with their FIRPTA Withholding obligations at closing. As every REALTOR® in Hawai'i already knows or should know, a buyer of real property is made liable to IRS for withholding and sending to IRS the 10% FIRPTA withholding tax unless the owner provides buyer with evidence of non-foreign status (to meet buyer's "burden of proof" in the event of an IRS inquiry). This general rule also applies to foreclosure sales. A REALTOR®'s failure to advise a client about his FIRPTA withholding obligation would expose REALTOR® to liability for his client's loss in the event that the IRS collects from the client-buyer the 10% FIRPTA withholding tax.

CE Credits for e-PRO Course
Earn three (3) hours of elective CE credits for the successful completion of the e-PRO course.
Once you receive your e-PRO certificate as verification of completion of the course, you may submit your CE request form and $10 processing fee to the Hawai'i Association of REALTORS®.
You may receive CE credits only for the biennium in which you complete the course. Submit the e-PRO CE request form to the Hawai'i Association of REALTORS®. Please allow approximately 10 days to process your CE credit.
